Considerations for same sex couples

It is more frequent for couples to live together without getting married or entering a civil partnership these days.

There is no requirement for any legal documents in place if you are cohabiting. It can however be helpful to clarify how you will deal with finances, care for children, and own your house.

By formally setting out the important arrangements in writing, you are both protecting your individual finances if the relationship ends. You can either prepare a Cohabitation agreement, or a declaration of trust to do this.

Prenuptial and postnuptial agreements

Another way to protect your rights is to sign a prenuptial or a postnuptial agreement.

If you’re currently unmarried, but you’re getting married soon, then you might think about a pre-nuptial agreement.

If you’re already married, but you’d like some sort of agreement in place, then the postnuptial agreement is suitable.

These sorts of agreements give you clarity about how to divide your assets if the relationship comes to an end. It may sound unromantic, however, discussing topics like this can be a good idea while youre on good terms and unclouded by emotions.

Dissolving a civil partnership

Whether you’ve decided that you want to end your civil partnership, or you’re just thinking through your options, we can help you plan your next steps.

You’re eligible to get a dissolution if you’ve been in your civil partnership for at least one year. If it’s been less than a year, then you might opt for a formal separation instead.

The process for dissolution is the same as the process for divorce. You do not need to give a reason – you can apply for a ‘no fault’ dissolution.
