What are the grounds for Divorce?

To petition for divorce, you must have been married for more than one year immediately preceding the presentation of the petition. The ground for divorce is the irretrievable breakdown of the marriage, and the petitioner, that is the person filing a petition for divorce, must use one of five different facts to support this statement.

  1. That the other party has committed adultery.
  2. That the other party has behaved in an unreasonable way.
  3. That the other party has deserted the petitioner for 2 years.
  4. That the parties have lived apart from each other for a continuous period of at least 2 years immediately preceding the presentation of a petition and the other party gives their consent.
  5. That the parties have lived apart for a continuous period of at least 5 years preceding the presentation of a petition.

Whether you are considering petitioning for divorce, or have received a petition for divorce, we are here to help. Contact us today for a free 45 min consultation to give you the opportunity to meet us before deciding if you wish to proceed in instructing us to act on your behalf.

During this appointment we will seek to understand the reasons for the breakdown of the marriage and discuss the various options available to you. If saving the marriage is unlikely, we will seek to understand more about you and your partner's income, savings, assets and pension arrangements so that we can begin to think about finding a solution to your future financial needs. We will also talk about children and options for their future arrangements.

We offer a free initial 45 minute appointment to give you the opportunity to meet us and find out more about traditional divorce before deciding if you wish to proceed in instructing us to act on your behalf.
