What is judicial separation?

Judicial (or legal) separation is a way for you to separate formally from your partner without getting a divorce or dissolving your civil partnership.

Some married people choose it when they know they want to separate (at least for a while) but they’re not sure if they want to end the marriage permanently yet.

Other people choose it for moral, cultural, or religious reasons because they don’t want to be officially ‘divorced’.

The court can make orders for your financial arrangements, and your arrangements for your children.

Separation agreements

Separation agreements are helpful for:

  • Married couples who want to separate, but do not yet want to divorce
  • Unmarried couples with children or joint assets, who want to separate

The agreement sets out how to divide your finances, who the children will live with, and what happens to any jointly-owned property.

Frequently asked questions

Unlike divorce, your marriage or civil partnership won’t come to an end when you receive the order for judicial separation.

That means that you’re not free to remarry.

You’d have to get divorced to do that.

Everything from:

  • Financial Matters: How to divide your and your partner's assets, saving, investments etc.
  • Property: Who stays in the family home and what will happen if it is sold.
  • Maintenance: the financial support paid to one partner or to support the children.
  • Practical Arrangements: agreements arounf living seperately. 

No, it is not a court order as such but may be apllied to a court for financial support later. It is important to get a solicitor to help ou with the agreement to ensure that it is correctly done and that both parties understadn the terms.
