It is important to understand that prenuptial agreements are not legally binding but they are increasingly recognised by the courts as being of importance. In 2010 there was a major shift in the weight courts attach to these agreements following the landmark case of Radmacher v Granatino. In this case decisive weight was given by the judge to the Prenuptial Agreement.

A Prenuptial Agreement is more likely to be upheld if it is reasonable to both parties, was agreed after full disclosure of finances and both parties received legal advice beforehand.
