At K J Smith Solicitors we are experienced and fully qualified to facilitate Family Mediation, ranging from the straightforward through to the highly complex.
Under section 10(1) of the Children and Families Act 2014, which came into force on 22nd April, it is now a requirement for a person to attend a Mediation Information Assessment Meeting (MIAM) before making an application to court on matters relating to children or making an application to court on matters relating to financial remedies.
Family Mediation is used to resolve family disputes and to help couples to reach a mutually agreed solution without the need of court action. The process works by couples agreeing to meet in a neutral environment with an impartial family mediator. The mediator will then aid the couples in coming to an arrangement that both parties are happy with. The family mediator can also be used to draw up a memorandum of understanding that can form the basis of a legally binding agreement.
Mediation can be very effective and can also be much cheaper than traditional divorce. In the event of a relationship coming to an end, family mediation is encouraged as the first step to resolving any issues. Mediation can be used to reach resolution on a wide range of family law matters, including financial settlements, maintenance payments and issues relating to children.
Family Mediation should be the first step to resolving any disputes, however it doesn't work in every case. It requires a level of trust and co operation between both parties so it's not always possible if the relationship has deteriorated beyond repair.
At K J Smith Solicitors we have a team of professional family mediators who are highly skilled in helping couples to resolve their differences.
