The marriage rate in England and Wales is declining meaning more and more couples are living together (cohabiting).

At present there is scant legislation in place tailored specifically to the needs of cohabiting couples and their children should their relationship break down. This can lead to disputes over ownership and entitlement to assets such as property and disputes relating to their children.

When unmarried couples separate, often they do not have a cohabitation agreement in place to cover such an eventuality. If the separating couple own property or other assets together this may give rise to issues relating to ownership.
