Ancillary Relief
Ancillary relief is the resolving of financial issues separately to the main divorce procedure and may extend the period of time it takes to obtain a divorce. The process of reaching a financial settlement within divorce varies depending upon the issues involved. Some financial settlements are reached without the necessity of the parties having to attend Court, whereas other matters proceed by way of a Court process. In either case the objective is to achieve a financial settlement which can then be incorporated into a document called a Consent Order. Once sealed by the Court this is legally binding. Whether or not the Consent Order is approved by the Court depends upon whether the Court considers the terms to be fair and equitable to both parties.
